Annual Leave

Regular Officers
Rules Rule 18 Leave Rules.
Entitlement :

 

Maximum 60 days in a calender year.
Must have performed duty for at least one day in that year to earn entitlement.
Must commence in same year. Exception : UN Mission 
For different years cannot be combined 
When combined with furlough leave, Annual leave to be taken first.
  • When combined with joining time, Annual leave to be taken first.
  • Debitable against sick leave.
  • Prefix / suffix allowed with express permission of sanctioning authority.
Pay and Allowances :

 

  • Entitled to full pay for Annual Leave.
  • Not entitled to field allowances.
  • Not entitled to transport allowance if absence including suffix/prefix is for a full calendar month.
Excess/irregular grant of A/L

 

  • Sanction of Div. Cdr. upto 30 days.
  • Sanction of Corps Cdr. more than 30 days and upto 60 days.
  • Sanction of Govt. of India for more than 60 days.

Casual Leave

Rules

 

  • Rule 17 Leave Rules.
Entitlement :

 

  • Maximum 20 days in a year.
  • Leave upto 20 days at a time may be granted at the discretion of the leave sanctioning authority.
  • Cannot be combined with any other leave.
Pay and Allowances :
  • Full pay and allowances.
  • Field allowances not admissible if CL exceeds 15 days

Furlough Leave

Rules

 

  • Rule 19 of Leave Rules for the services.
Entitlement :

 

  • 2 months in a block of 3 calendar years from the year of commission.
  • Non accumulative.
  • If taken in broken spells, cannot exceed 60 days.
  • Cannot be combined with previous/ next furlough.
  • In case of non regular officers undertaking required that if he does not complete initial engagement, then he will refund furlough pay and allowances.
  • Re-employed,NCC whole time, NCC PC & MNS(L) not entitled.
  • Cycle of furlough leave to be quoted correctly in Part II order.
Pay and Allowances :
  • Half Pay in the Pay Band + half grade pay + half MSP.
  • DA on pay as above.
  • No field allowance.
  • If furlough covers full calendar month (including prefix/suffix) transport allowance not admissible.
  • No Para pay.
  • No specialist pay if holding annotated appt.
  • No entertainment allowance.

Study Leave

Rules :

 

  • Regular Officers of AMC-AI 13/78 & Rule 29 Leave Rules.
  • Regular Officers of ADC-AI 18/79 & Rule 28 Leave Rules.
  • Regular Officers of RVC-AI 137/66 & Rule 30 Leave Rules.
  • Regular Officers other than above-AI 42/82 & AO 11/87
Entitlement :

 

  • 24 months in service, extendable upto 28 months including Annual Leave and furlough during year of commencement.
  • Cannot be combined with any other leave.
  • Joining time and journey period not entitled on proceeding/rejoining from study leave.
  • If minimum 3 years of service not rendered after leave pay and allowance including cost of course incurred by Govt. to be recovered.
Pay and Allowances :
  • Full pay including NPA.
  • No transport allowance.

Sick Leave

  • Hospitalisation exceeding 30 days.
  • Admissible maximum up to 180 days on full.
  • Pay & Allowances thereafter at forlough rates on action of competent authority.
  • Regularisation from first day of admission to the hospital necessary.
  • Not to be combined with casual leave, sick list concession.

  • Field allowances not admissible during sick leave.

  • Transport Allowance not admissible during sick leave.

  • Sick leave continued to the next year would not affect sick leave entitlement of that calendar year.

Special Casual Leave

  • For participation in sports of National/International importance.

Maternity Leave

Rules :

 

  • Rule 56 Leave Rules
Entitlement :
  • Lady officers maximum 180 days of full pay.
  • In case of first year of service, undertaking required that officer will continue in service for another year from rejoining.
  • Extension for one month without pay in addition to AL & Furlough requires sanction of DGAFMS.
  • In case of combination of leave, annual leave to be granted first, followed by furlough and maternity leave.
Pay and Allowances 
  • Full pay & allowances for 180 days.

Terminal Leave

Rules :

 

  • Rule 51 Leave Rules
Entitlement :
  • Only to SSC Officers employed for minimum of 3  years
  • Maximum of 28 days in year of termination of engagement.
  • Can be combined with Annual Leave which granted first.
Pay and Allowances:

 

  • Will be paid furlough rates of pay without DA for all periods falling after date of completion of tenure of service.
  • Full Pay & Allowances will be restored on receipt of  Non-employment certificate & Non-practicing certificate{ in case of medical officers }
  • Entitled to retain acting rank
  • Increment due during leave is admissible

Accumulation of Annual Leave

  • Maximum thirty(30) days in a year
  • Newly commissioned officers granted commission before 1st December and reporting for duty in first/second week of December can accumulate maximum fifteen (15) days for that year.
  • SSC officers cannot accumulate AL in year of termination
  • Only AL can be accumulated.
  • Maximum accumulation 300 days.

Encashment of leave on LTC

  • Maximum 10 days annual leave encashable during a calendar year.
  • irrespective of nature and number of leave availed on LTC.
  • Total number of days encashed and number of days accumulated during a calendar year do not exceed 30 days.
  • Total 60 days annual leave encashable during entire service.
  • Annual leave encashed on LTC upto 31st Aug 08 to be deducted from maximum ceiling encashable at the time of retirement / release.

  • Availing LTC by the officer is mandatory for LTC encashment.

  • Reference of warrant used / LTC claim submitted to CDA (O) in the certificate to be incorporated in the Part II Order is a must.

  • Elements for LTC encashment would be pay in the pay band + Grade Pay + MSP + NPA(if any) + DA thereon.

  •  Officers who have acquired qualifications listed in AHQ, DGMT letter No. A/63088/GS/MT-10 dated 26-11-2001 on or after 1-8-1997 are entitled to Qualification Grant at the appropriate rates as under:-

         (a)    Qualification listed in category I       -      Rs. 20,000/-

         (b)    Qualification listed in category II      -      Rs.   15,000/-

         (c)    Qualification listed in category III     -      Rs.   9,000/-

         (d)    Qualification listed in category IV    -      Rs.   6,000/-

 

  • The Qualification Grant is admissible as under

  1. To officers of all ranks who have completed 2 years service.

  2. Admissible on each occasion an officer acquires a recognised qualification on or after 1.8.97.

  3. In case any qualification listed for Qualification Grant also qualifies the officer for any other monetary benefit, he will be entitled to only one such grant as per the option given by officer.

  4. Qualification Grant is not admissible to AMC / ADC officers.

  5. Qualification Grant is not payable to officers in receipt of Technical Allowance.

  6. Qualification grant is not admissible for qualification acquired before the date of commission.

  7. Qualification grant admissible only for notified course an officer is detailed on or is sanctioned study leave for. Any other course done by the officer on his own (with or without the approval of the CO / Competent Authority) does not entitle him for Qualification Grant.

Procedure for claiming Qualification Grant

Same as that of Technical allowance.

Technical Allowance

  Rates

Technical Allowance is admissible to technically qualified officers as under:-

1) To officers who possess any of the qualification listed in AHQ letter No. A/63088/GS/MT-10(1) dated 26-11-2001 at the rates given below:       

  • Tier I Courses       -     Rs 2000/- per month

  • Tier II Courses      -     Rs 3000/- per month

2) Technical Allowance is admissible w.e.f. 1-8-97 or from the date of acquisition of the qualification whichever is later.

3) Technical Allowance is admissible for a maximum of one course from each Tier.

4) The maximum amount of Technical Allowance will not exceed Rs. 5000/- p.m.

5) Technical graduates who have been granted antedate of seniority are not eligible for Technical Allowance for a qualification which made them eligible for commission as a Technical Graduate. However, as per AHQ letter dated 7.7.2003, Tech. graduates are entitled to Tech. Allowance Tier I on completion of YO's course or equivalent.

6) Technical Allowance Tier II will be admissible only to those who have acquired qualification given for Tier I prior to their eligibility to Technical allowance Tier II. Technical Allce Tier II is admissible only to eligible officers of the rank of Capt. and above.

7) If a course is listed both for Technical Allowance and Qualification Grant, the officer shall have the option to choose for Technical allowance or Qualification Grant. Option once exercised cannot be revoked. Technical Allowance and Qualification Grant are not admissible concurrently.

8) Technical Allowance is not admissible to AEC officers.

9) Technical Allowance is not admissible for MSc (Def Studies)/MMS,M.Phil etc., granted for attending DSCC/LDMC/HC/NDC and OAME courses.

Procedure for claiming Technical Allowance

1) All officers will forward their claim to CDA(O) in the proforma prescribed by AHQ in Circular dt. 8-5-2002 together with photostat copies of certificates in respect of civil qualification and or Part II Order or course report in respect of service qualification duly countersigned by Commanding Officer. In case CO is not satisfied by the documents produced by the officer, the claim will be countersigned by the parent Dte at AHQ.

2) Re-employed officers will forward their claim together with a certificate from the CO that they are employed on Technical/Maintenance duty.

3) Claims will be preferred by all affected officers including those who are already in receipt of Technical Pay.

Para Allowance

 

  • Admitted to officers posted to Para units, employed on Para duties and holding authorised appointment.
  • Officer should undergo Para basic course and Para refresher course every year thereafter.
 
  • Rate Rs. 1200/- per month.
 
  • Admitted for Para year i.e. 1st July to 30th June of every year.
  • Part II orders required every year for continuation.
  • Exemption from Para refresher course may be granted by Bde. Cdr.

  • Admitted when trained Parachutists are transferred to Para reserve

  • Officers should have minimum 3 years service in Para unit.

  • Admitted to Army Aviators serving in Army Aviation Corps and holding vacancy in authorised estt.

  • An advance flying instructor/flying instructor course required to be undergone provided officer is deployed on AOP duties after the course.

  • Admitted to officers who are blind or orthopaedically handicapped at twice the normal rate. If residing within 1 Km. admissible at normal rate.
  • Admitted to Maj.Gen. and above if not using staff car.
  • Not admitted during absence when such absence is for full calendar month(s) w.e.f. 22/2/2002.
  • Certificate as per AHQ letter dt. 17/06/1998 and amended vide letters dt. 13/01/1999 dated 19/05/1999 and dated 16 Dec 08 duly countersigned required.
For officers upto the rank of Brig

Cost ceiling
  • 134 times of basic pay (inclusive of rank pay + DP) subject to a minimum of Rs.7.5 lakhs and a maximum of 18 lakh. The Head of the Dept. if satisfied can relax the cost ceiling up to maximum of 25% of cost ceiling
Quantum of HBA
  • Maximum limit of HBA is 34 months basic pay (inclusive of rank pay + DP) subject to a maximum of Rs.2,10,000/- or the cost of house or repaying capacity whichever is least for new construction/purchase of new house/flat
  • 34 months basic pay (inclusive of rank pay + DP) or Rs.2,10,000/- for enlargement of existing house or cost of the enlargement or repaying capacity whichever is the least.
Recovery of advance
  • The instalment amount of recovery and the number of instalments will be fixed by sanctioning authority including the month of recovery
  • This will depend on the repaying capacity which is computed on the basis of length of service
  • If the officer is unable to repay the advance with interest before retirement, the recovery will be made from pensionary benefits
  • The No. of instalment shall not exceed 240 instalments (180 for recovery of principal amount and 60 for recovery of interest)

Eligibility
  • The advance will be granted to those officers whose basic pay plus rank pay plus DP is Rs.10,500/- or more
Sanctioning authority
  • Refer Para 25 of SAI 4/S/66
Procedure
  • Application in the prescribed form i.e. IAFZ-2160 in triplicate through normal channel to sanctioning authority
Quantum of advance
  • Admissibility as per V CPC orders
  • (SPC orders awaited)
  • On the 1st occasion Rs.1,80,000/- or 11 months basic pay (Basic Pay + Rank Pay + DP) whichever is least. If the actual price of car purchased is less than the advance then the officer shall refund the balance amount within 15 days
  • On the 2nd occasion Rs.1,60,000/- or 11 months basic pay + rank pay + DP or anticipated price of the motor car whichever is the least.

Note – 2nd or subsequent advance will be admissible only after a lapse of 4 years from the date of drawal of last advance

 

Recovery of advance
  • The recovery will be in such number of equal monthly installment as the officer may elect but not exceeding 200 (Principal + interest). For those retiring within 1 to 10 years of drawal of advance, the recovery of advance will be adjusted in such a way so that advance and interest is recovered before retirement

  • In the event of any delay in supply despite written assurance from the dealer, the officer concern with apply for extension of time limit within the permissible period on one month to the sanctioning authority
  • Extension beyond this period can be sanctioned by the Govt.
Rate of interest
  • For the Year 2007-2008, the interest rate is 11.5%
Method of calculation of interest  
  • Simple interest on the balance outstanding on the last day of each month
  • Interest will be calculated by applying the following formula. When
  1. Principal repaid in equal instalments from month to month:

d) Entitlements of TA/DA on Temporary Moves / Permanent Duty & LTC

Clarifications :-

            Consequent to the implementation of GOI, MoF letter No. 19030/3/2008-E.IV dated 23<sup>rd</sup> Sep 08 some doubts have been raised which were examined and the following has been clarified:

Point of Doubt Clarification
i)  Whether Daily Allowance is uniform for all classes of cities No classification of cities for Daily Allowance is given in the OM.  Therefore it is uniform for all classes of cities.
ii)  Whether Daily Allowance will be paid during journey period It is clarified in MoF letter No. 19030/3/2008-E.IV dated 19 Nov 08 that Daily Allowance in monetary terms is no longer admissible to Central Govt employees, hence actual expenditure incurred within the prescribed limits will be reimbursed as per normal procedure of reimbursement for period of tour.
iii)  Whether any advance on account Hotel charges, food bill, taxi fare, etc may be paid Advance of Traveling Allowance is admissible under provisions of Rule 48 to 51 of Compendium of Advances contained in GFR.  This advance may include elements of Daily Allowance.  These orders continue to remain in force.
iv)  Whether hotel/guest house should be registered/recognized Note 1 below GoI decision 1 below SR 51 clarifies that for stay in a Hotel, the govt servant must have stayed in any establishments registered / licensed as a hotel, by proper authority.  This continues to be in force.
v)   Whether cash receipt / cash memo will be mandatory in support of the claims. Yes, as clarified in MoF letter No. 19030/3/2008-E.IV dated 19 Nov 08 actual expenditure incurred within the prescribed limit will be reimbursed as per normal procedure of reimbursement.
Note:- Attention is drawn to MoF Department of Expenditure OM No. 19030/3/2008-E.IV dated 22/1/09 vide which option of availing DA at old rates has been given.
vi)   Whether the conditions stipulated in Rule 67(c)(ii) TR are still operative as govt orders do not specify entitlement for baggage conveyed by road when places are connected by train. The matter has been referred to the Ministry for clarification.  Until then status quo ante VI CPC will be maintained.  i.e. stipulation of restricting claims of personal effects by road between places connected by rail to rail fare plus 25% will be continued.
vii)   Reimbursement of accommodation charges, food bills and taxi bills
  1. Whether slips given by taxi drivers i.e. without proper receipt or charges claimed without bills are acceptable in audit.
  2. Whether NAC from the ty duty point is mandatory to admit accommodation charges for stay.
  3. In case if officer is detailed on ty duty at two points located at distances more than 50 kms in the same city, the entitlement of TA, in case of govt. transport not provided.
  4. Whether conveyance charges, food bills for local temporary duty are acceptable as the same forms component of DA in new package of DA.
  5. Whether 50% of these components are admissible as stipulated in TR 129.
  6. Whether food bills and ration allowance are concurrently payable or ration money per day as stipulated in Rule 114(xii) TR is recoverable.
  1. Cash receipt / cash memo will be mandatory in support of the claims.
  2. Claims may be regulated in accordance with GoI, MoF Deptt of Exp. letter F.No. 7(1)/E.Coord/2008 dated 1<sup>st</sup> Oct 08.
  3. As per Note 4 below TR 114(vi), local journeys beyond 8 kms should normally be performed in the same way as the service personnel / civilians perform the journeys to his duty points i.e. by bus, local trains or his own conveyance, where travel by special means of conveyance like taxi, scooter, etc. is considered necessary.  Prior permission of superior authority should be obtained.  Mileage as per prescribed rates will be accordingly admitted.
  4. Conveyance charges, food bills for local ty duty are acceptable.
  5. Conditions of TR 129 are still in existence.
  6. Provisions of Rule 114(xii) still in force.  Hence food bills will be reduced by the cost of ration.
viii)  Provisions regarding DA for courses at Cat 'A' Estt. not mentioned in the Govt orders.

The halt DA for courses at Cat 'A' Estt. are preferred through consolidated advance requisitions by the Commandants of the colleges from Course DA section with reference to rate of DA of the city.

  1. Whether the claims may be preferred duly mentioning the accommodation charges, food bills i.e. messing charges charged.
  2. As per the existing procedure as per V CPC, License Fee bills are received in r/o officers with govt. single accommodation by Cat 'A' Estts for adjustments through IRLAs of the officers.  As per the new package of DA as per SPC orders, officers are entitled for reimbursement of accommodation charges as a part of DA component.  Whether recovery of license fee for stay at accommodation provided by Cat 'A' Estt has to be stopped and the actual charges as mentioned in the claims to be reimbursed.
 
  1. Yes.  Accommodation charges, food bills should be shown separately in the claims.
  2. This practice will be continued, if license fee charged is within the ceiling for reimbursement for accommodation as mentioned in MoD letter No. 12630/Mov C/ 3737/D(Mov)/08 dated 29 Dec 08.
ix)   Entitlements for journeys on tours/transfer within the country - officers in the grade pay of Rs. 5400/- and above are entitled to perform journey by air

Whether sanction to travel under own arrangements as per TR 47(iii) is mandatory to be submitted with the claims as officers are entitled for free railway warrants on duty and LTC journeys.

Yes. Sanction to travel under own arrangements as per TR 47(iii) is mandatory to be submitted with the claims.

 2.           As per para 3 of Annexure of MoF letter No. 19030/3/2008-E.IV dated 23<sup>rd</sup> September 2008, reimbursement of taxi charges up to 50 kms for travel within city for officers having grade pay of Rs.7600/- & above and Rs.50/- to 150 per diem for other is admissible.  The doubts raised and clarifications received are as follows:

i)  Whether reimbursement is admissible for actual distance traveled from point of stay to duty point. Clarified vide MoF letter No. 19030/3/2008-E.IV dated 14<sup>th</sup> October 2008 that the present provision of GoI order 7 below SR-46 continues to be applicable in addition to reimbursement of taxi / travel charge within the city, within prescribed limits.
ii)  Whether maximum limit of taxi charges i.e. for 50 kms prescribed is admissible straight way. As clarified in 2(i) above.

3.             During implementation of GoI, MoP, Public Grievances & Pension F.No. 31011/4/2008-Estt(A) dated 23<sup>rd</sup> Sep 08 regarding clarifications on LTC, some doubts have been raised which were examined and the following has been clarified:

Point of Doubt Clarification
i)  The quantum of leave to be encashed separately for both husband and wife for availing LTC for different station, if both are Central Government employees.  Whether any endorsement is required while finalizing the LTC claim. Entry to the effect is mandatory in service book of the officers.
ii)  LTC to children staying in the hostels : Children of service personnel staying in hostels are permitted to visit their family on LTC.
  1. The clause under which such journeys have to be availed has not been specified.  Please confirm whether a special clause under Rule 177 will be considered for child LTC, being new provision incorporated / introduced.
  2. Whether children studying in hostel perform journey from SPR / Duty station of officer to home town / any where in India in addition to their LTC to visit family.
  3. Whether hostel subsidy claim to be linked to confirm children's stay at hostel.
  4. Whether the concession is extended to the children staying away from the family for pursuing studies but staying under own arrangements and not staying in a hostel.
This is not related to VIth CPC.  However, LTC to children staying in the hostels will be covered under 'Provisions of dependent children residing away from the service personnel's HQ' which are already existing vide para 1(h) of CS no. 59/X/2002(Amendment to TR 176).

4.             As per  MoP, Public Grievances & Pension F.No. 31011/4/2008-Estt(A) dated 23<sup>rd</sup> Sep 08 regarding clarifications on LTC, travel entitlements for the purpose of official tour / transfer or LTC, will be the same but NO DAILY ALLOWANCE shall be admissible for travel on LTC.  In case of Air Travel instruction issued vide Ministry of Finance F. No. 7(1)/E-Coord/2008 dated 10<sup>th</sup> Nov 08 and 4<sup>th</sup> Dec 08 would be applicable

Point of Doubt Clarification
i)  Whether RMA payable in respect of LTC journey from Home to nearby Rly station can be paid. No.  As per clarification No. 15 of DOP&T OM No. 31011/8/98-Estt(A) dated 31/3/99, incidental expenditure incurred on local journeys between residence / place of stay and the airport / railway station / bus terminal are not reimbursable.
ii)  As the difference of entitlement between TA & LTC has been abolished, whether any fare e.g. private bus fare / taxi fare payable for temporary duty can also be admitted in respect of LTC. No MoP, Public Grievances & Pension F.No. 31011/4/2008-Estt(A) dated 23<sup>rd</sup> Sep 08 clarifies that only journeys performed in vehicle operated by govt or any corporation in the public sector run by the Central or State Govt or a local body are permissible.
